Disclaimer and Limitation of Liability as to Products Sold Cooltechnica.com makes no representations or warranties, either express or implied, of any kind with respect to products sold on the Cooltechnica.com sites. This disclaimer in no way affects warranties provided by the manufacturers of products sold on this site. Except as expressly stated herein, Cooltechnica.com expressly disclaims all warranties, express or implied, of any kind with respect to products sold on this site, including but not limited to, merchantability and fitness for a particular purpose. You agree that the sole and exclusive maximum liability to Cooltechnica.com arising from any product sold on the Cooltechnica.com sites shall be the price of the product ordered. In no event shall Cooltechnica.com, its directors, officers, employees or other representatives be liable for special, indirect, consequential, or punitive damages related to product sold. All orders require 24-48 hours processing time before ship. Cooltechnica.com does not guarantee same day shipping. Cooltechnica.com does not process orders during weekends. Cooltechnica.com reserves the right to ship via an alternate method so that your package arrives within the designated shipping time as specified on your order, (e.g. ground shipping from a local warehouse for an overnight order, since it will arrive at the promised time). We will not be able to refund your account if your package arrives as specified. We reserve the right to choose the shipper (UPS or FedEx) for deliveries, costs being equal. All items purchased at Cooltechnica.com are to be used at your own risk. When used properly, all Cooltechnica.com products are absolutely safe. Damage to computer components and possible bodily harm can occur if a product is used improperly. Cooltechnica.com assumes no liability whatsoever, expressed or implied for the use of these products. We do not guarantee compatibility. On all water cooling and related products, including accessories all sales are final unless otherwise noted. Defective items will be replaced. See Return Policies for more info. Please Note: For security purposes, orders totaling one thousand dollars or more, may require some forms of identification before processing. We reserve the right to cancel unfulfilled orders at any time or request payment in advance through money order or certified bank check. Pictures are for illustration purposes only. Typographical Errors In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Cooltechnica.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. We are not responsible for typographical errors, even if an invoice was issued in error. Cooltechnica.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Cooltechnica.com shall immediately issue a credit to your credit card account in the amount of the charge. Sales Taxes Cooltechnica.com shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within Massachusetts. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state. Payment Terms Terms of payment are within Cooltechnica.com's sole discretion, and unless otherwise agreed to by , Cooltechnica.com. Payment must be received by prior to Cooltechnica.com's acceptance of an order. Payment for the products will be made by credit card, wire transfer, or some other prearranged payment method unless credit terms have been agreed to by Cooltechnica.com. Invoices are due and payable within the time period noted by Cooltechnica.com based on the purchase, measured from the date of the invoice. Cooltechnica.com may invoice parts of an order separately. Orders are not binding upon Cooltechnica.com until accepted by Cooltechnica.com Any quotations given by Cooltechnica.com will be valid for the period stated on the quotation. Customer agrees to pay interest on all past-due sums at the highest rate allowed by law. Return and Exchange Policy < Top > Important note for Shipping Damages: All FEDEX and UPS packages are fully insured. If you receive a damaged package, you must notify us immediately by phone at +1 (978) 223-2864 . Sending back damaged merchandise voids the shipping insurance and no credit will be given. Damaged packages must be held for seven business days with original packaging for FEDEX or UPS inspection. Cooltechnica.com systems and parts that are purchased directly from Cooltechnica.com by an end-user customer may be returned by Customer in accordance with Cooltechnica.com's "Return Policy" in effect on the date of the invoice. Products returned for credit must be received within 30 days of invoice date and a 15% restocking fee will apply. Product must be returned within 30 days. Systems are returnable for repair or replacement only. No returns on any computer water cooling products. Defective products will be replaced! Cooltechnica.com will not assess a restocking fee for defective products. A qualified Cooltechnica.com technician will test each returned product for defects. Warranty is void if a product has been tampered with in a way in which it was not designed. Misuse, modification, handling damage (i.e. dropping) will void warranty. Returned items must be in like new condition. Returns will not be accepted without an authorized RMA number, which is valid for 14 days after being issued. When you contact us, we will issue a Return Merchandize Authorization Number (RMA #) for you to include with your return. You must return the products to us in their original or equivalent packaging, prepay shipping charges, and insure the shipment or accept the risk if the product is lost or damaged in shipment . We will return the repaired or replacement products to you. We will pay to ship the repaired or replaced products to you if you use an address in the United States (excluding Puerto Rico and U.S. possessions and territories). Otherwise, we will ship the product to you freight collect. Customers are responsible for return shipping charges on merchandise, including Defective On Arrival (DOA) products. The customer is responsible for shipping the product back, and Cooltechnica.com does not reimburse the return shipping cost. This is analogous to paying for gas to drive a product back to a store you bought from to return it, which is not reimbursable. Please ship using a carrier that provides a tracking number and proof of delivery. We recommend UPS or Fedex. Cooltechnica.com will not be responsible for items lost by the carrier. Valid proof of delivery must include the receipt signature of an authorized Cooltechnica.com employee. Some Rules to follow for Return Merchandize Authorization:
Exchanges From time to time, Cooltechnica.com may, in its sole discretion, exchange products or portions of a product. Any exchanges will be made in accordance with Cooltechnica.com's exchange policies in effect on the date of the exchange. Cooltechnica.com does not cross ship products. Cancellations on Systems This only applies to Pre-Built, Barebones, and Custom Computer Systems, including Watercooled PCs and workstations built by Cooltechnica.com. Any cancellation on system orders must be emailed to cooltech@cooltechnica.com within 24 hours of the placement of the order. Any cancellations placed after 24 hours will result in a 15% restocking fee. Service and Support for System Purchase Cooltechnica.com endeavors to provide the best customer and technical telephone support in the personal computer industry. For end-user Customers, Cooltechnica.com promises that its support people will attempt to handle over the telephone any problem involving Cooltechnica.com. Support for systems is available through our toll free 800 tech support number.However, Cooltechnica.com's support people may not be able to understand or resolve any given problem. Service offerings may vary from systems to parts. Please note that unless otherwise noted we only provide technical support for Cooltechnica.com barebones, complete computer systems (including PC and workstations) and parts used in them.The parts and assemblies used in building Cooltechnica.com products are selected from new parts and assemblies in accordance with industry practices. We don't provide support for parts installed by the end user (customer). Any modifications to our parts or systems void our warranty.Cooltechnica.com has no obligation to provide service or support until Cooltechnica.com has received full payment for the product or service/support contract for which service or support is requested. Cooltechnica.com does not offer Third Party Support. We don't provide technical support for other manufacturer's parts and products that we sell in our stores. ships each order via UPS or FedEx. Rates are automatically calculated
by UPS or FedEx Online Shipping Calculator by accordance of weight. Our
weights are fairly accurate, but they are not exact. We add $2.00 to the
postage charge for handling. The handling charge covers our supply costs,
wages, etc. Cooltechnica.com reserves the right to ship via an alternate method so that your package arrives within the designated shipping time as specified on your order, (e.g. ground shipping from a local warehouse for an overnight order, since it will arrive at the promised time). We will not be able to refund your account if your package arrives as specified. We reserve the right to choose the shipper (UPS or FedEx) for deliveries, costs being equal. Any shipment to an APO address will be done via USPS Priority Mail and a $13.00 handling will apply. For APO shipments, you should e-mail sales@cooltechnica.com right after placing your order online. Otherwise your order may be cancelled. Shipping charges are not included in the price of the item . Shipping time is not guaranteed; shipping cost is also not guaranteed. We are sorry, but we can not refund the shipping charges for weather related delays. Cooltechnica.com does not take responsibility for delayed arrivals on packages shipped to rural areas. Cooltechnica.com does not take responsibility for delayed arrivals due to closed or delayed airport activity. Taxes - Separate charges for shipping and handling will be shown on Cooltechnica.com's invoice(s). By law, no sales tax will be added to orders placed on the Internet as long as Cooltechnica.com ships the product to you (the buyer). The only exception to this is if you are a resident of the states of Massachusetts, in which case State Tax will apply. Sales taxes do apply if you (the buyer) pick up the merchandise at our location even if the original purchase was placed online. Applicable taxes will be shown on Cooltechnica.com's invoice. International Shipping < Top > Cooltechnica.com can provide international shipping. Wire transfer is the preferred method for international orders but credit cards can also be accepted. International orders may require some forms of identification before processing. Unless otherwise noted all international shipments will be made via FedEx International Priority or Economy. If FedEx doesn't ship to the country or area that you reside in, we may not be able process your order, in which case we cancel your order. Overseas orders may be subject to import tax. We do not charge for this tax, so the customer will have to take care of it separately. You are responsible for, if any customs, duties, taxes, or additional fees your country or the shipping company charges to import these items. Once the package leaves the borders of the United States there is very little we can do to track the package. We are not responsible for any package that is damaged or lost due to another country's customs or postal service. Shipping time is not guaranteed; shipping cost is also not guaranteed. If the item is lost, damaged, or delayed by the shipping service - we are not responsible. No refunds, credits, or replacements will be given by Cooling Gear Worldwide Inc, DBA Cooltechnica.com. Canadian customers: UPS will charge you an import fee if shipping through UPS Standard (ground). UPS or FedEx International Air shipping methods are faster and covers these fees. Shipping Charges for Returns Cooltechnica.com provides shipping to the sender only. Unless
otherwise noted, shipping on products and returns is nonrefundable, and
returning a product comes at the expense of the customer. For complete systems with operating system, Cooltechnica.com will pay for shipping both to and from Cooltechnica.com within the first 30 days of invoice date.. After 30 days, Cooltechnica.com covers shipping to the sender only and the customer will be responsible for shipping charges to Cooltechnica.com. All systems must be sent to Cooltechnica.com in original shipping packaging. If this is not possible, the system must be double boxed, and shipment must be insured by the carrier. Jurisdiction and Venue You agree that any legal action brought against Cooltechnica.comshall be governed by the laws of the State of Massachusetts without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the Cooltechnica.comworld wide web sites shall be an appropriate federal or state court located in the State of Massachusetts. Privacy Policy < Top > Cooltechnica.com respects our customers' right to privacy. Cooltechnica.com in no way sells your personal information or uses it in anyway other then to process your order. We do not sell or share this information with anyone. Your name, street address, and phone number will not be seen by anyone except our shipper and credit card processing service to expedite your order. We keep information you send to us for the purpose of your viewing of your order, tracking information, and RMA support. All personal information that is sent to Cooltechnica.com is encrypted using Secure Socket Layers (SSL). SSL is used in an effort to prevent a third party from intercepting the information while it is in transit to us. For futher protection, your crucial data kept on our servers is also encrypted and password protected. Cooltechnica.com's policy is one of ongoing product update and revision. Cooltechnica.com may revise and discontinue products at any time. Cooltechnica.com will ship products that have the functionality and performance of the products ordered. Not all products are compatible.
